“Berry Denmark”, “we”, “us” and “our” refer to Popcorn Media in these terms.

Berry Denmark is your contracting party. All designs are developed by Berry Denmark in Denmark. Physical products are produced and dispatched on our behalf by our production partner in Lithuania.

These terms apply to consumer purchases on berrydenmark.com and berrydenmark.dk and to the use of our online store.

Placing an order

You must check your order before purchasing, including the design, phone model, case type, quantity, email address and delivery address.

After ordering, you will receive an order confirmation by email. Contact us as soon as possible if any information is incorrect.

Changes to an order can only be made where still practically possible. This does not limit your statutory cancellation or return rights.

If we have supplied the product you ordered, selecting an incorrect phone model or case type does not constitute a fault in the goods. In that situation, the ordinary return rules apply.

Prices and payment

Prices and payment currency are displayed in the online store and at checkout. Prices for Danish consumers include VAT. Any additional charges we impose are disclosed before purchase.

We accept AMEX, Apple Pay, Google Pay, VISA, MasterCard, Maestro, Shop Pay and UnionPay where available at checkout.

We do not charge card fees.

Payment for physical products is captured only upon dispatch. Payment for eGift Cards is captured upon electronic delivery of the gift card. A card authorisation is not a completed charge.

Obvious pricing errors are not binding if you knew or should have realised that an error had occurred. Price changes after purchase do not change a price already agreed.

Production and preparation

We do not hold stock of finished goods. Physical products are made to order and printed and packed for each individual order.

The estimated preparation time is 24–48 hours on business days. Shipping time is additional and starts from dispatch.

The fact that a standard product is made to order does not, by itself, make it personalised or exempt it from the return rules.

Minor differences between the on-screen appearance and the physical product may occur due to screen settings and materials. The product must still meet the agreed specifications and the requirements of the Danish Sale of Goods Act.

Shipping and delivery

We offer free delivery with no minimum order to the destinations available at checkout.

Estimated shipping times from dispatch are:

Destination Estimated shipping time
Denmark 1–3 business days
Available EU destinations 1–3 business days
United Kingdom and Ireland 1–3 business days
Australia, Fiji and New Zealand 2–3 business days
USA and Canada 3–4 business days
Other available destinations 2–5 business days

The preparation time of 24–48 hours on business days is additional.

Delivery times are estimates. Customs clearance, transport conditions and other delays may affect shipping times. Your statutory rights in the event of delay or non-delivery are not affected.

Berry Denmark bears the risk for the goods until they have been delivered to you or someone you have designated. If you independently arrange transport with a carrier we have not offered, the specific legal rules on the transfer of risk apply.

Deliveries outside the EU may be subject to local customs duties, import taxes and customs clearance charges. If these charges are not included or collected at checkout, they are payable by the recipient under the destination country’s rules.

Delivery address and receipt

You must provide a correct and complete delivery address, including any floor, unit or apartment number.

Follow the carrier’s notifications and collection deadlines. Failing to collect or refusing delivery of a parcel does not, by itself, constitute notification of cancellation or a return.

If delivery fails because you provided incorrect information, or the parcel is returned as uncollected, any additional costs are assessed under applicable law. We do not charge a standard penalty for failing to collect a parcel.

Cancellation before dispatch

To cancel before dispatch, open the order on your order page and follow the cancellation instructions.

Once the parcel has been dispatched, withdrawing from the purchase is handled as a return. It may not be possible to stop a parcel in transit.

Exceptions for personalised products are explained below.

Returns after dispatch

You generally have 14 days from receiving your purchase to notify us that you wish to return it. This is your statutory right of withdrawal for online purchases.

The period begins on the day after you, or someone you have designated other than the carrier, receives the goods. If items from the same order are delivered separately, the period generally begins after the last item is received.

If the deadline falls on a Saturday, Sunday or public holiday, it is extended to the following working day in accordance with applicable law.

Open the relevant order on your order page, register the return and follow the instructions. When you submit your notification electronically, you will receive confirmation by email.

You may also notify us of your decision while the parcel is in transit. The goods must then be returned in accordance with the rules below.

As an alternative to your order page, you may provide another unequivocal statement, for example by emailing hello@berrydenmark.dk, or use the separately available model withdrawal form.

Return deadline and address

You must send the goods back within 14 days of notifying us that you wish to return your purchase. The deadline is met if you dispatch the goods before the period expires.

Send returns to:

Popcorn Media / Berry Denmark
Industriparken 34
9560 Hadsund
Denmark

You must ensure that the correct item is sent to the correct address. Please include your order number to help us identify your return.

Registering a return or waiting for it to be processed does not extend the dispatch deadline.

We do not accept parcels sent cash on delivery. In-person returns are not available. Choose delivery to the return address rather than a collection point requiring pickup.

Return shipping and responsibility in transit

For ordinary returns, you arrange and pay for return shipping. We do not provide prepaid return labels for ordinary returns.

You choose the carrier and shipping method. You bear the risk for the returned goods until they are received at the return address, including the risk of loss, misdelivery and damage in transit.

You are responsible for correct addressing and adequate packaging. The packaging must protect the goods during transport, including against pressure, impact, moisture and contact with other objects.

The original product packaging may not provide sufficient protection as outer shipping packaging. Use protective outer packaging where necessary.

We recommend tracked shipping with appropriate compensation coverage. Keep your proof of postage and other documentation. Choosing tracking or insurance does not change the allocation of responsibility between you and Berry Denmark.

If the goods are lost or damaged during return shipping, you are responsible under applicable rules for losses for which you bear the risk. Any claim against your chosen carrier must be directed to that carrier.

Evidence of timely dispatch affects when a refund becomes due but does not, by itself, transfer the risk of return transport to Berry Denmark.

These rules apply to ordinary returns. For valid claims concerning faulty or incorrect goods, we cover the necessary costs under the Danish Sale of Goods Act.

Condition of goods and diminished value

You may examine the goods to the extent necessary to establish their nature, characteristics and functioning.

Where the legal conditions are met, you are responsible for any diminished value resulting from handling beyond what is necessary for that examination.

Diminished value may result from scratches, marks, breakage, dirt, incorrect installation or use beyond necessary testing.

For screen protectors, installation, removal of protective layers and subsequent removal from the screen may affect resale value. Any deduction depends on the specific handling and diminished value. A deduction is not applied automatically simply because the packaging has been opened.

Goods must be returned with the parts and accessories included in the purchase. Missing parts may be taken into account when assessing diminished value.

We recommend keeping the original packaging and protective inserts. Original packaging is not an absolute requirement for exercising your statutory right of return.

We may deduct a documented reduction in value from your refund. Deductions are assessed individually and are not a standard fee.

If the goods have no actual remaining value because of handling for which you are responsible, the diminished value may, depending on the circumstances, equal the full purchase price of the item.

Personalised products

The right to withdraw from a purchase does not apply to goods made to your specifications or clearly personalised, for example with your own photographs, names or individual text.

Selecting from our standard designs, phone models and case types does not, by itself, constitute personalisation.

This exception does not affect your rights concerning faulty goods.

Partial returns and promotions

We accept partial returns within the ordinary return period under the conditions described here. Original delivery charges, if any, are not refunded for partial returns.

If you received a discount for purchasing several items together, such as 3 for 2 or buy 3 and receive 30% off, the discount is adjusted if its conditions are no longer met after the return.

The refund is calculated using the price that applied at the time of purchase, without the promotional discount, for the items you keep. The adjustment will not result in a charge exceeding the original order’s total price.

Example: If you buy three equally priced cases under a 3 for 2 offer and return one case, you keep two cases. As you have already paid the ordinary price for the two cases you keep, the refund in this example is DKK 0.

If you return the entire purchase, all items included in the offer must be returned, including any free item.

Promotional adjustments do not limit your rights when making a valid claim concerning faulty goods.

Refunds

When you exercise your statutory right of withdrawal, we refund the amount you are entitled to without undue delay and within 14 days of receiving your notification.

For physical goods, we may withhold the refund until we have received the goods or evidence that they have been sent back, whichever occurs first.

Lawful deductions may be made for documented diminished value and promotional adjustments.

When the entire order is returned, any original delivery charges are refunded up to the cost of the least expensive standard delivery we offered at the time of purchase. Any additional charge for a more expensive delivery method is not refunded. Where delivery was free, there is no original delivery charge to refund.

Refunds are issued using the same payment method used for the purchase unless expressly agreed otherwise. We do not charge a refund fee when you exercise your statutory right of withdrawal.

Your bank’s or payment provider’s processing time may mean that the funds appear in your account later.

Exchanges

For an ordinary exchange, register and return the item through your order page, then place a new order for the product you want.

You pay the return shipping costs. For faulty or incorrect goods, the complaints procedure applies instead.

Complaints about faulty goods

You have a 24-month statutory right to complain about faults under the Danish Sale of Goods Act.

You must report a fault within a reasonable time after discovering it. A complaint made within two months of discovering the fault is always considered timely.

Register your complaint through your order page with a description of the problem and, where possible, photographs. You can also contact hello@berrydenmark.dk.

We are entitled to examine the alleged fault. We may request relevant information and, where necessary, ask you to make the goods available for inspection.

A valid complaint is handled under the Danish Sale of Goods Act, including its rules on repair, replacement, proportionate price reduction or termination of the purchase agreement. You do not have an unconditional right to demand a refund as the first remedy where the legal conditions for repair or replacement are met.

We cover the necessary costs of resolving a valid complaint, including necessary return shipping.

Your statutory rights concerning faults do not cover ordinary wear or damage caused by accidents, misuse, incorrect installation or inadequate maintenance where the issue does not result from a fault in the product.

Protection and liability

A case or screen protector is not insurance against every type of damage to your phone. Products must be used with the model and in the manner for which they are intended.

Damage to a phone or accessory does not, by itself, make Berry Denmark liable for compensation. A claim for compensation requires the conditions for liability under applicable law to be met.

Berry Denmark does not provide a separate guarantee to compensate for phones, screens or other equipment unless expressly agreed.

This does not limit liability for faulty goods, mandatory product liability, liability for personal injury or any other liability that cannot lawfully be excluded.

Delivery of eGift Cards

An eGift Card is delivered as a printable PDF by email within 24 hours of placing your order.

The gift card is sent to the email address selected at purchase. You must check the email address and any requested name or text for the gift code before ordering.

Contact hello@berrydenmark.dk as soon as possible if there is an error. Correction or reissue requires the gift card to be identifiable and capable of being handled without duplicate redemption.

Using eGift Cards

The gift card covers the products stated on it. It does not entitle the holder to additional products or services beyond those agreed.

Gift cards are redeemed on berrydenmark.com against the designs, phone models and case types available when ordering. A gift card does not reserve specific designs or products.

Free delivery is included when ordering the products covered by the gift card. No separate delivery value is payable.

A gift card for one case can be combined with our advertised 3 for 2 offer: the gift card covers one case, the customer pays for one additional case, and the third is free. All three cases must be ordered together.

Other discounts can only be combined with the gift card where stated in the offer or agreed at purchase.

Redeeming eGift Cards in one order

All included cases and any screen protector should generally be ordered together in a single order.

The gift code is technically configured for one use. Check that all included products have been added to your cart before completing your order.

If the code is used without all included products, it cannot be used again at checkout. Any remaining entitlement to products or value is handled manually through hello@berrydenmark.dk.

Deactivating the code does not, by itself, extinguish any remaining entitlement or value. The same value cannot be redeemed or paid out more than once.

Gift card validity and payout

An eGift Card is valid for product redemption for one year from the date of issue. The validity period is disclosed before purchase, and the expiry date appears on the gift card.

After expiry, the gift card cannot be used to order products. Extensions are not granted automatically. Mandatory rules requiring a longer validity period take precedence over this provision.

Under the Danish Payments Act, the holder may request payment of any remaining value during the validity period and for up to one year after the expiry date.

Send your request to hello@berrydenmark.dk, including the gift card or gift code. We may request information necessary to verify the gift card’s authenticity, remaining value and entitlement to payment. The original purchase receipt is not required.

The remaining value is calculated under applicable law, taking into account factors including any face value of the gift card and previous redemptions.

For payout before the expiry date, the administration fee is DKK 29. The fee is charged only where agreed before purchase and where the amount corresponds to our actual, reasonable costs of making the payment.

No fee is charged for payout requests made from the expiry date until one year afterwards.

After this period, we do not offer voluntary payout or extensions unless otherwise agreed or required by mandatory law.

Cancelling an eGift Card purchase

When purchasing an eGift Card online, you generally have a statutory 14-day right of withdrawal from the date the contract is concluded.

Register cancellation through your order page. The gift card is deactivated when a refund is issued.

A name or personal text in the gift code does not, by itself, remove this right.

No payout fee is charged when you exercise your statutory right of withdrawal. If the gift card has already been redeemed in full or in part, any refund and associated product purchases are handled under applicable rules. No duplicate refund will be issued.

Gift codes and security

Gift cards and gift codes must be kept confidential. Anyone with access to the code may be able to use it.

A name or personal text in the code does not constitute identity verification or restrict its use to a particular person.

Contact hello@berrydenmark.dk immediately in the event of loss, theft or suspected misuse. Where possible, we will block an unused code once the gift card and entitlement to it have been verified.

Lost gift cards are not automatically replaced. A replacement code requires verification of the gift card and any remaining entitlement or value. Value already lawfully redeemed or paid out will not be replaced.

Mandatory statutory rights remain unaffected.

Use of the online store and intellectual property

The online store may only be used for lawful purposes. Misuse of payment methods, gift codes, customer accounts or personal data, or attempts to bypass security measures, is prohibited.

You are responsible for protecting your login details and providing accurate information when purchasing.

In cases of documented misuse or reasonable suspicion of fraud, we may restrict access to an account and investigate an order to the extent permitted by law. This does not, by itself, remove existing consumer rights.

Rights to protected logos, designs, images, text and other materials belong to Berry Denmark or the relevant rights holders. Commercial copying or other infringing use is prohibited.

Shopify and external websites

Shopify provides the technical platform. The purchase agreement is entered into with Popcorn Media, which operates Berry Denmark.

Links to external websites do not mean that Berry Denmark assumes responsibility for their content.

We remain responsible for our own agreements, products and partners to the extent required by applicable law.

Personal data

Popcorn Media is the data controller responsible for processing personal data in connection with Berry Denmark.

Read our separate Privacy Policy on the website for information about processing, retention, recipients, any international transfers and your rights.

Questions can be sent to hello@berrydenmark.dk.

Complaints and dispute resolution

Contact hello@berrydenmark.dk if you wish to complain about a purchase.

If we cannot reach a resolution, you may submit a complaint to the Mediation Team for Consumer Complaints at Nævnenes Hus, provided the eligibility requirements are met. A case may subsequently be considered by the Danish Consumer Complaints Board under the applicable rules.

Nævnenes Hus
Toldboden 2
8800 Viborg
Denmark

Current financial thresholds and guidance on the complaints process are available on the Nævnenes Hus website.

Governing law and changes

The agreement is governed by Danish law. This does not deprive consumers of protection under mandatory rules in their country of residence where those rules apply.

Disputes are handled in accordance with the applicable rules on jurisdiction.

These terms may be changed for future purchases. Changes do not apply retrospectively to agreements already concluded.

These terms do not limit rights or liability that cannot lawfully be excluded or restricted.
